Uruguayan consulates abroad are in charge of receiving visa applications and provide information on the requirements to apply for a visa.

A Fast Track procedure is available to simplify and expedite the access to visas (work, business and family reunification) and residencies, for people who are linked to an exporting company based in Uruguay.

The registry of private employment agencies is a nation-wide registry in which all companies that take part of the labor market performing tasks like: personnel selection, mediation and/or labor supply must be registered in order to obtain the necessary license. Seeks to encourage the hiring of certain groups of people providing subsidies to the companies.
Talent Attraction Law

Under the scope of this law, technicians and professionals of the IT sector settled in Uruguay can choose to contribute to the Non-Resident Income Tax (IRNR, for its acronym in Spanish) (12% flat rate) and can also choose to not contribute to the social security system in Uruguay.

Requirements:

  • Must be a foreigner or a national citizen.
  • Must be a non-tax resident in the country during the last 5 fiscal years before moving into Uruguayan territory.
  • Tax residence is set by complying with any of the following criteria:
    1) Prolonged stay of more than 183 days in the country.
    2) Vital interests in the country (presumption of a spouse and underage children).
    3) Establishment of the nucleus or main base of operations in the national territory.
    4) Base of economic interests in the country (investments).
  • Perform a full-time activity in national territory, exclusively as a dependent worker, including all revenue of their work as employees (only one source of income).
  • Provide services to companies that operate on a regular and permanent basis in the country.

The practice of a gainful activity requires mandatory registration with the Social Security Entity (BPS), both by employers and employees, as well as by self-employed individuals, who must also register and pay dues. Access more information on Social Security and its requirements here.

Environmental Working Conditions (CAT) deals with the different techniques applied to the prevention of psychophysical integrity in the workplace, such as hygiene, safety and occupational medicine.

Workers’ rights include, among others, limited working hours, leaves of absence, salary supplements and severance pay. In addition, workers must join the social security and health system that covers disability, retirement, sickness, occupational accidents, maternity leave, unemployment and death.

According to national legislation, foreign workers have access to the same rights and obligations as nationals, and employers are required to comply with applicable labor and social security laws without distinction of the individual’s place of birth.

Visas

The administrative process that a foreigner who wishes to temporarily or permanently reside in Uruguay goes through before the National Direction of Migration in order to obtain the regularization of their stay and obtain the Uruguayan ID card (with the exception of residences covered by Law N°19254).

The Letter of Citizenship is the certifying document when a person acquires the nationality of another country, for reasons such as prolonged legal residence, through marriage or offspring, among others.

Once approved, it becomes valid for an indefinite period of time, however, it can be renounced or lost, in accordance with the provisions of the current legislation.
